This has recently been brought to my attention, again...
"Eastern Truck and Accessory still has your pics up on their off road pics page."
www.etaoffroad.com
I have spoken with these clowns in the past and been promised that the pictures of my jeep that are on their website would be removed since I have no affiliation with them or their shop and they have definitely never done any work on my jeep. They told me once before that someone that worked there knew me or some BS story like that. As far as I know, I don't know anyone that does or has worked there. If anyone has worked there or knows these guys at all, please let me know and please ask them to take the pictures off since as I see it, they are basically using my jeep as false advertising for vehicles they have worked on. The pictures of my jeep were all taken by me or close friends of mine with no connections to off roading, so there is also the whole copyright issue, blah blah blah
thanks

that's not *exactly* how it works. who ever took those pictures (mike's friend) retains copyright ownership from the second that he took that picture and it was made tangible/viewable by some means (like, looking at it on the display of the camera, or on a computer screen, or printing it out). Along with ownership, he gets to say who can use it and who can't and under what conditions. The owner of that picture only needs to actually register for a copyright if he is seeking to license the image, or if he is seeking a lawsuit. Posting the pictures on a website, or a public forum or whatever doesn't constitute "public domain". They are considered "public knowledge" but are not considered a work of creative commons. Now, since those pictures are being used by someone else to make money (get more customers), this is where the situation gets sticky. My suggestion would be to call up the shop, and ask them to remove the pictures or else they will be contacted by an IP lawyer concerning copyright infringement and pending lawsuit. perhaps mention that it could cost them in excess of $30,000 (and as much as $150,000) should they choose to defend their case. wait and see if they call the bluff...jonesy wrote:unless they just take them down as a favor, good luck. the pictures are public domain as they were posted on a public forum and they were taken on public land. i had the same problem with pictures of me kayaking ...

I asked them once before to take them down and they acted as if I should feel special to have my pictures up there and could not understand why I would not want them up. They said they would take them down next time they updated their site, within 30 days or so, this was over a year ago. I have not thought about it again until recently when someone brough it to my attention that they are still up. Some of the pictures were taken by me on my camera and some were taken by my friend on my camera, so they have no rights to use any of them without permission, not matter where they downloaded them from. If someone took a picture of my jeep and put it on their website, which has also happened, then there is nothing I can do because in that case I have no ownership of the pictures. It just bothers me that an "offroad" shop doesn't actually have enough of their own pictures to use, maybe if they weren't spending their time stretching trucks, widening jeeps or putting on gay lowering kits then they could go take their own damn pictures. Whether they take them down or not, I just want people to know that the place seems to be a joke when it comes to real 4x4's.

Having lived in VA Beach, all of the 4X4's down there are a joke. The reason most of the trucks and jeeps down there are lifted so much is that they haven't ever been taken off-road to break anything. Pretty hard to snap axle shafts in the Pembroke Mall parking lot.
